The Right to Refuse

Every worker in Ontario has the right to refuse work they have reason to believe is likely to endanger them or another worker. It is one of the three core rights under the Occupational Health and Safety Act, alongside the right to know about hazards and the right to participate in health and safety.

The right comes with a process, and the process is what protects the worker. A refusal is reported to the supervisor or employer, the worker stays in a safe place nearby, and the situation is investigated with the worker and a worker representative present. If the matter is not resolved, it goes to a Ministry of Labour inspector, whose decision governs. Walking off site is not a refusal and does not carry the same protection.

Reprisal against a worker for exercising the right is prohibited. This track exists because the right is widely known to exist and much less widely understood in its steps — and a refusal handled badly, in either direction, tends to end up in front of an inspector.
