Due Diligence Blues

Section 27 of Ontario's Occupational Health and Safety Act puts specific duties on a supervisor personally, not on the company they work for. A supervisor must ensure workers comply with the Act, must ensure required protective equipment is used, must advise workers of hazards they are aware of, and must take every precaution reasonable in the circumstances for a worker's protection.

That last phrase is where prosecutions turn. Due diligence is not a filing cabinet; it is the record of reasonable steps actually taken before something went wrong. A supervisor who identified a hazard, raised it, followed up, and documented the response is in a very different position from one whose only evidence is a signed training sheet.

The song walks through those duties in the order a supervisor meets them on a shift. It is aimed at working supervisors who were promoted off the tools and were never told, in plain language, what the Act now expects of them personally.
